MusherHub

Terms of Service

Effective 12 October 2026

These terms apply between Sidèra and the kennel or business that uses MusherHub (the "Customer"), and to every person the Customer invites into the app (a "User").

1. The provider

MusherHub is provided by Sidèra, the sole proprietorship of Noa De Clercq, Kraailokerkweg 19, 9990 Maldegem, Belgium, enterprise number (KBO) 1036.955.338, info@sidera.be.

2. The service

MusherHub is software for managing a sled dog kennel: dog profiles, team line-ups, schedules and tours, run tracking with GPS, feedback and dog history. It is offered as a web app and as an iPhone and Android app. MusherHub is a business tool; it is not offered to consumers.

3. Accounts

4. Not a safety device

MusherHub is not an emergency, rescue or safety system. Positions can be delayed, inaccurate or missing because of coverage, battery, cold, device settings or the operating system stopping the app. Never rely on MusherHub to locate people or dogs in an emergency, and keep your own safety procedures in place.

5. Location tracking of staff

The Customer decides whether and when runs are tracked. Before using run tracking, the Customer informs its staff and guides, in a way that meets the employment and privacy law that applies to it, of what is recorded, why, who can see it and how long it is kept, and has a valid legal basis for it. Sidèra provides the Privacy Policy to help with this, but it does not replace the Customer's own obligations as an employer.

6. Acceptable use

Do not use MusherHub to break the law, to track people outside of work runs, to upload content you have no right to use, to try to access another kennel's data, to probe or overload the service, or to resell it without our written agreement.

7. Fees

Fees, the subscription period and the number of dogs or sleds included are set out in the offer or order confirmation the Customer accepts. Unless agreed otherwise, fees are invoiced in advance for each period, exclusive of VAT, and payable within 30 days. Sidèra may suspend access after a written reminder if an invoice remains unpaid for more than 30 days after its due date. Free or trial access may be ended at any time.

8. Your data

9. Availability and changes

Sidèra works to keep MusherHub available and secure but does not guarantee uninterrupted or error-free operation. Maintenance is planned outside peak tour times where possible. Sidèra may improve and change the app; if a change removes a feature the Customer depends on, the Customer is told in advance and may end the subscription with a pro-rata refund of prepaid fees.

10. Liability

Sidèra's total liability under these terms is limited to the fees the Customer paid for MusherHub in the 12 months before the event that caused the damage. Sidèra is not liable for indirect damage, such as lost revenue, lost bookings or lost data that could have been avoided by exporting it. These limits do not apply to fraud, intentional misconduct or gross negligence, or where the law does not allow them.

11. Term and termination

The subscription runs for the period in the order and renews for the same period unless either party gives notice at least 30 days before the end. Either party may end the agreement immediately if the other seriously breaches it and does not fix the breach within 30 days of a written notice. After the end, the Customer can export its data for 30 days; then the data is deleted.

12. Data processing terms

For personal data of its Users that the Customer puts into MusherHub, the Customer is the controller and Sidèra the processor. This section forms the data processing agreement required by article 28 of the GDPR.

  1. Subject and duration: providing MusherHub, for as long as the agreement runs, plus the 30-day export period.
  2. Data and people: the account, location and content data described in the Privacy Policy, concerning the Customer's staff, guides and other invited Users.
  3. Instructions: Sidèra processes the data only to provide the service and on the Customer's documented instructions, including these terms and the settings the Customer makes in the app, unless the law requires otherwise.
  4. Confidentiality: anyone at Sidèra with access to the data is bound to confidentiality.
  5. Security: encryption in transit, access control per kennel and role enforced in the database, limited administrative access, and automatic deletion of routes after 12 months.
  6. Sub-processors: the Customer authorises the sub-processors listed in the Privacy Policy (Supabase, Netlify, and the map providers). Sidèra informs the Customer of a new sub-processor at least 30 days in advance; the Customer may object and, if no solution is found, end the agreement.
  7. Transfers: data is stored in the EU. Where a sub-processor processes data outside the EU, appropriate safeguards apply, such as the EU–US Data Privacy Framework or standard contractual clauses.
  8. Assistance: Sidèra helps the Customer, as far as reasonable, to answer requests from people exercising their rights and to meet its obligations on security, impact assessments and prior consultation.
  9. Breaches: Sidèra notifies the Customer without undue delay, and where possible within 48 hours, after becoming aware of a personal data breach, with the information available at that point.
  10. End: at the end of the agreement Sidèra deletes the data after the export period, unless the law requires it to keep it.
  11. Audits: Sidèra makes available the information needed to show compliance with this section and cooperates with a reasonable audit, at the Customer's cost and with reasonable notice.

13. Changes to these terms

Sidèra may update these terms. Material changes are announced at least 30 days in advance; if the Customer does not accept them, it may end the agreement before they take effect.

14. Law and disputes

These terms are governed by Belgian law. Disputes that cannot be settled amicably go to the courts of Ghent, Belgium.
